ILR

ILR in the uk a business, or living in the country for any other reason for a number of years consistently without a break, you may be eligible for ILR. The UK Visas and Immigration (UKVI) grants such people the opportunity to make an application to live in the UK for an indefinite period.

The laws and regulations pertaining to making an application for ILR are strict and complex. The decision of the authorised body depends on the finer details of your current and previous visas, where you have lived, and whom you have worked under during your stay in the UK.  That is why it is essential to have a knowledgeable and experienced immigration solicitor by your side to ensure that your ILR application is prepared carefully without any mistakes or errors that can otherwise prove to be very costly.

The Eligibility Criteria for ILR

To apply for an ILR, it is mandatory for an applicant to undertake the Life in the UK test. This test provides information regarding the applicant’s life in the UK and an idea of their level of proficiency in the English language. However, applications aged over 65 or under 18 years of age are exempt from taking the Life in the UK test, mainly because of their inferior mental or physical capabilities.

People can qualify for ILR through a number of categories under the UK Immigration rules. These include:

  • Applicants who entered the UK on a two-year fiancé visa, civil partner visa, spousal visa, and same sex partner visa
  • Applicants who entered on a fiancé visa, civil partner visa, spousal visa, or same sex partner visa, but their relationship broke down due to domestic violence
  • Applicants who entered as a refugee and were grant five years leave
  • Applicants who have been in the country on a valid Tier 1 or 2 visas, HSMP, work permit, or any other combination of visas cumulating to a five-year period

It is important to note that if you are making an application for ILR, make sure it is prior to the expiry date of your current visa.
